Rule 98
Exceptional family instincts and gifts

(1) If a civil servant dies immediately due to an accident in the course of government work or if he dies later without recovery due to the same, his wife or husband will be given fifty percent of the minimum pension as per sub-section (2) of section 37 of the Act as a separate lifetime monthly family allowance and more. As a gratuity, the amount of three months' salary received by the deceased employee will be given in one lump sum.
(2) The widowed husband or widowed wife of a civil servant will be recognized only in the following cases:-
(a) Before the incident of death due to the above-mentioned causes, the civil servant must have had a marital relationship.
(b) At the time of the death of the civil servant, he must have been living with him.
(3) If there is no widowed wife or if she has separated from her husband before his death, or if such widowed wife was born before her remarriage, the child or adopted son of the deceased employee may be given a lump-sum payment of the lump-sum gratuity specified in sub-rule (1). However, if there are children or adopted children under the age of eighteen years, for the purpose of their livelihood, the government of Nepal can also give them additional family allowance at a rate determined by the discretion of Damasahi not to exceed two-thirds of the number of family allowance received by a widowed wife until they reach the age of eighteen years.
(4) If the deceased civil servant's widow or widower, children or adopted children are not adopted, and if the employee's dependent parents are both or one of them, then for their maintenance, the family allowance shall not exceed two-thirds of the family allowance received by the widower or widow. (5) If there is any dispute regarding the widow, widower or descendants of the deceased civil servant, the Government of Nepal can take action in a proper and just manner.
(6) The deceased civil servant's widower, widow, offspring, adopted son, adopted daughter or mother and father, and if such employee's dependent brothers, sisters or unmarried sisters or any of them remain,For the purpose of maintenance of money, the government of Nepal can provide family allowance at a rate deemed reasonable by the family allowance not exceeding two thirds of the number of family allowance received by the widowed husband or widowed wife for a period as deemed appropriate by the Government of Nepal. =Explanation: For the purpose of this rule, 'mother and father' in the case of a married female civil servant shall also mean her mother-in-law and father-in-law.
